Residency Requirements
In Texas, a spouse must have resided in the state of Texas for 6 months and resided in the same county for a period of 90 days prior to filing for a divorce.
Example:
If a married couple moves to San Antonio, Texas on January 1 then moves to Dallas on July 1, then the couple must wait until they have lived in Dallas for 90 days before filing for divorce in Dallas.
In this example, one of the spouses may file on October 1.
